Estate planning may include a Revocable Living Trust, which is a written document drafted during your lifetime, just like a Will, except that the assets transferred into the Trust avoid probate. Probate can be expensive and time consuming. The probate file at the courthouse is open to the public. Therefore, a Living Trust should be considered as an effective method to avoid probate.

There are many uses for a Living Trust, including:

1.  The avoidance of probate.

2.  Protection against mental incapacity, by naming a trustee to manage assets in the Trust
     in the event of incapacity.

3.  Inclusion of provisions for married couples to eliminate or reduce estate taxes.

Our preparation of a Living Trust normally includes the following services:

1.  Preparation of a Revocable Declaration of Trust.

2.  Preparation of a Will to pour over into the Trust any assets which are not transferred into the Trust and which
     go through probate.

3.  Preparation and recording of a deed to transfer your residence or other real estate into your Trust.

4.  Power of Attorney for financial matters.

5.  Advance Health Care Directive and Living Will.


We also practice in the areas of real estate and business law, including the formation of business entities such as corporations and Limited Liability Companies (LLCs). Many real estate issues are handled by our office including  drafting  deeds, joint venture agreements and other documents as well as advice about options for the titling of real property.
